Submitting a DMCA Takedown Notice
If you believe that your copyrighted work has been copied, used, or displayed on our website in a way that constitutes copyright infringement, please send a written DMCA notice to our Designated Agent. To be valid, your notice must include all of the following:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed (or a representative list of such works, if multiple).
- Identification of the infringing material and information reasonably sufficient to permit us to locate the material on the website (such as specific URLs).
- Your contact information, including your full name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
Counter-Notification (Response by Alleged Infringer)
If your content has been removed or disabled because of a DMCA notice and you believe that removal was a mistake or that you have authorization to use the material, you may submit a counter-notification to our DMCA Agent.
Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed or disabled.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or, if outside of the U.S., to the jurisdiction of any judicial district in which Future Real Estate may be found) and that you will accept service of process from the person who provided the original DMCA notice.
Upon receipt of a valid counter-notice, we may reinstate the removed material after ten (10) business days unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
Repeat Infringer Policy
Future Real Estate reserves the right to terminate, in appropriate circumstances and at its sole discretion, accounts of users who are deemed to be repeat infringers. We may also limit access to the website and/or terminate accounts of any users who infringe any intellectual property rights of others, whether or not repeat infringement is involved.
Good Faith & Accuracy
Please note that submitting false claims or misrepresentations in a DMCA notice or counter-notice may result in liability for damages, including costs and attorneys’ fees, under the DMCA (17 U.S.C. §512(f)).
